TENTATIVE RULING:

 

Plaintiff LJL Strategy LLC moves to compel Defendant Diya Holdings LLC to respond to the first set of requests for production of documents and to compel Defendants Diya Holdings LLC, Jairaj Samtani, and Chhaya Samtani to respond to the first set of form interrogatories.  For the following reasons, the unopposed motion is GRANTED.

 

Responses to interrogatories, requests for production of documents, and requests for admission are due 30 days after service (plus appropriate time for method of service).  (Code Civ. Proc. §§ 2030.260; 2031.260.)  If the party to whom a discovery request is directed fails to respond timely, that party waives all objections, including claims of privilege and work product protection.  (Code Civ. Proc. §§ 2030.290(a) (inspection demands); 2031.300(a) (interrogatories); 2033.280(a).)

 

On March 16, 2022, Plaintiff served Defendants with the form interrogatories (set one) and requests for production of documents (set one).  (Ideta Dec., ¶ 3, Exs. A-D.)  Defendant Diya Holdings LLC has not served responses to the first set of form interrogatories, and Defendants Diya Holdings LLC, Jairaj Samtani, and Chhaya Samtani have not served responses to the first set of requests for production of documents.  (Id., ¶ 5.)  Given Defendants’ failure to respond to Plaintiff’s discovery requests, Plaintiff is entitled to an order compelling responses without objection.  (Code Civ. Proc. §§ 2030.290, 2031.300.)  Because Defendants did not timely respond, objections to the discovery requests are waived. (Code Civ. Proc. §§ 2030.290(a), 2031.300(a).) 

 

Defendant Diya Holdings LLC is ordered to serve responses without objections to the first set of form interrogatories within 30 days of notice of this ruling.  Defendants Diya Holdings LLC, Jairaj Samtani, and Chhaya Samtani are ordered to serve responses without objections to the first set of requests for production of documents within 30 days of notice of this ruling.

 

Defendants are ordered to pay sanctions in the amount of $1,035 (3 hours at $325 per hour plus the $60 filing fee) to Plaintiff within 30 days of notice of this ruling.  (Code Civ. Proc. § 2030.290, § 2031.300.)
