Defendant Fidelity Brokerage Services, LLC’s Petition to Compel Arbitration of all the claims asserted by Plaintiff Thomas E. Smurro in his Complaint against Fidelity is CONTINUED to September 27, 2023, at 9:00 a.m. in this Department.

Plaintiff’s operative Complaint is not available in the Register of Actions or the court’s filing system, and none of the parties included the Complaint among their exhibits or request for judicial notice. The court is not able to determine if arbitration should be compelled in an action where the court has never seen the Complaint.  No further briefing is permitted.
