TENTATIVE RULING: 

 

Motion to Compel Responses to Form Interrogatories

 

Plaintiff Watt Properties, Inc., moves to compel responses from Defendant Kamil Finan and Defendant Mary Finan to Form Interrogatories-General (Set One). For the following reasons, the unopposed motion is GRANTED.

 

Due to Defendants’ failure to serve timely responses to the interrogatories (Koonce Decl. ¶¶ 4, 8), Defendants have “waive[d] any right to exercise the option to produce writings under Section 2030.230, as well as any objection to the interrogatories, including one based on privilege or on the protection for work product . . . .”  (Code Civ. Proc., § 2030.290(a).) Defendants Kamil Finan and Mary Finan shall provide verified responses, without objections, to Plaintiff’s Form Interrogatories (Set One) no later than 30 days from the service of the notice of ruling.

 

Plaintiff’s request for sanctions is granted. Defendants Kamil Finan and Mary Finan shall pay sanctions in the amount of $652.50 to Frank Law Group, P.C. no later than 30 days from the service of the notice of ruling. (See Code Civ. Proc., §§ 2023.010(d), 2030.290(c).)
