Order re Proposed [Amended] Judgment

The Court had asked the parties to meet and confer and submit an appropriate judgment.  Much of the case was resolved by Judge Mooney when he conducted the phase 1 trial and issued his Decision.  The balance was either resolved between the parties or by the Court’s December 1, 2022 ruling on Defendant USA National Title Company, Inc’s Motion for Judgment on the Pleadings.

Generally, the purpose of the meet and confer process it to engage in the “give and take” outside the courtroom so that only the issues that must be resolved by the Court are presented to the Court.  This case was a little “bumpy” in that regard. What took place was a series of filings starting with Plaintiff’s Objections filed December 20, 2022 (7 pages plus exhibits).  A proposed judgment was not submitted until January 4, 2023 (3 pages plus numerous attachment pages.)  On January 5, 2023 Plaintiff filed his Objections to the January 4, 2023 lodged judgment.  On January 12, 2023 Defendants Tung and Huang filed their Response to the Objections (4 pages plus exhibits.)  Also on January 12, 2023 an Amended [Proposed] Judgment was lodged.

It appears to the Court that the meet and confer process has now run its course.  It appears that the “disputes” have been resolved.  The Court intends to sign the Amended [Proposed]Judgment lodged January 12, 2023.

If any material objections remain to be addressed the parties must bring them to the attention of the Court at the January 17, 2023 hearing.
