Motion to Compel the Deposition of Defendant’s Person Most Knowledgeable

BACKGROUND

The complaint in this Song-Beverly Warranty Act case was filed on April 5, 2021. General Motors timely filed an objection to the deposition of its PMK; however, GM has indicated that it would provide a PMK for most of the categories of questions in the deposition notice. GM primarily objected to the categories that were overly broad or went beyond the scope of Plaintiffs’ 2018 Chevrolet Colorado. Despite this, Plaintiffs’ motion to compel deposition includes even the categories to which GM has agreed to produce a PMK. GM indicated in its opposition that Plaintiffs did not meet and confer prior to filing the motion to compel.

The Court has reviewed the documents filed related to this motion and will not decide the motion on the merits at this time. The parties must make an effort to meet and confer. An Informal Discovery Conference will be scheduled.

ORDER

1.      The parties are ordered to conduct a meaningful meet and confer.

2.      Prior to the Informal Discovery Conference, the parties are ordered to provide the Court with a joint statement of the remaining issues, and those issues should only be ones to which General Motors has not already agreed to provide a PMK.
