and Arnulfo Perez filed a notice of related case seeking to relate this case to
Jesus Castro v. Andres A.
Diaz Perez, et al., No.
22STCV22705. Plaintiff filed that action
against the same defendants on July 14, 2022.
On August 9, 2022, plaintiff and defendants
stipulated to dismissing the new action and to permitting plaintiff to file a
third amended complaint in this case. On
August 10, 2022, plaintiff submitted a request to dismiss the entire action
without prejudice in case No. 22STCV22705.
The dismissal has not yet been entered.
The court finds no efficiency in ordering these
cases related. Relating and reassigning
cases is discretionary. (CRC 3.300(h)(1)
[“cases may be ordered related”.)
The parties stipulated to dismissing the new action. Plaintiff thus agreed to abandon it. Relating the cases and reassigning the new
action to this court would serve no purpose.
The court finds the two cases are not related.
