Judge: Douglas W. Stern, Case: 22STCP02613, Date: 2022-08-23 Tentative Ruling

Case Number: 22STCP02613    Hearing Date: August 23, 2022    Dept: 52

Tentative Ruling:

Petitioner State Farm Mutual Automobile Insurance Company’s Petition for Assignment of Superior Court Case Number for Purpose of Issuing Subpoenas for Telephone Records and Witness Testimony

Petitioner State Farm Mutual Automobile Insurance Company petitions the court to assign a case number so it can issue subpoenas.  State Farm contends that, though its insured, respondents Anna Afrikyan and Artyom Afrikyan, authorized State Farm to request their cell phone records, their cell phone providers will not produce records without a subpoena.  (Petition, ¶¶ 7-10, Exs. 1-2)

Respondents Anna Afrikyan and Artyom Afrikyan were served with the petition and notice of this hearing but did not file any response or otherwise appear in this proceeding.

The court finds this petition is moot because State Farm has already achieved the relief it seeks.  When State Farm filed the petition on July 13, 2022, the clerk of the court assigned it a case number: No. 22STCP02613.  The court sees no reason to issue any further order.

The petition is denied as moot.
