Motion to Compel Responses to Requests for Production of Documents (Set Two)

            Plaintiff Kinte Hogan filed this wrongful death action as to the death of his mother, Cathy Blevins, against Defendant Mehmet Demirozu, M.D., (Defendant) and other Defendants on January 13, 2022. On October 26, 2022, Defendant served Demand for Inspection and Production of Documents – Set Two. Responses to this discovery were due on November 28, 2022. (Motion at p. 3.) As of the filing of the motion on December 20, 2022, no responses had been received.

            No opposition has been filed as of March 6, 2023.

A propounding party may move to compel responses to requests for production of documents where the responding party fails to provide responses. (CCP § 2031.300.) The responding party must provide responses within thirty days after the demand is served. (CCP § 2031.030(c)(2) & (3).) The responding party waives all objections, including privilege and work product, by failing to timely respond to requests for production of documents. (CCP § 2031.300.)

Plaintiff has failed to provide responses to Defendant’s request for production of documents. Defendant has moved for an order compelling production of those documents. The Court grants Defendant’s motion to compel responses.

Plaintiff is ordered to provide responses without objections within 20 days of the service of notice of this Order.
