Seneca Insurance Company, Inc. vs. Warrior Trans Inc., et al., case No. 22STCV06893

 

In this case, Plaintiff is requesting Default Judgment against Defendants (1) Warrior Trans Inc., (2) Jitendar Singh, and (3) Gurpreet Singh. This is a subrogation claim.  There was a auto accident.  Defendant Gurpreet Singh was the driver of the vehicle that caused the accident.  Defendant Warrior Trans. Inc. owned the vehicle driven by Gurpreet Singh.  The submissions adequately describes the basis for imposing liability upon those two defendants.  However, default judgment is also sought against Jitendar Singh, and there is no mention of him in the default package.  If Plaintiff desires a judgment against Jitendar Singh, a factual basis must be shown.

 

In Plaintiff’s Default Judgment package, Plaintiff has not included a proposed form of judgment or form JUD-100, as required by Cal. Rules of Ct 3.1800(a)(6).  That must be submitted.

 

Finally, there is not a clear calculation of the $3,938.55 requested in interest.  A proper calculations must be submitted if interest is sought.

 

Plaintiff must cure the above noted defects.
