Tentative Ruling:

The Demurrer and Motion to Strike are taken off calendar.

The Cross-Complaint which is the subject of these two hearings was filed June 14, 2022.  The Demurrer and Motion to Strike were filed on July 20, 2022 with a hearing date of September 7, 2022.  On August 23, 2022 the parties lodged a STIPULATION RE FILING OF FIRST AMENDED COMPLAINT AND [PROPOSED] ORDER THEREON.  It was signed by the Court on August 29, 2022.  It provided that a First Amended Complaint would be filed forthwith.  It also provided that Defendant/Cross-Complainant shall have 30 days to file a responsive pleading.

On August 25, 2022 Cross-Complainant filed a First Amended Cross-Complaint.

In light of these events, the Court shall take the Demurrer and Motion to Strike attacking the original Cross-Complaint off calendar.  The First Amended Cross-Complaint shall be the operative Cross-Complaint at this time.
