On September 8, 2023 the parties filed their “STIPULATION TO STAY HEARING ON DEFENDANTS’ DEMURRER TO SECOND AMENDED COMPLAINT and [PROPOSED] ORDER” advising the Court that they have reached a settlement in principle and are working to finalize the settlement.  They requested that the Court take the hearing on the demurrer set for September 12, 2023 “off calendar” and stay the hearing on the demurrer.

1.  In light of the parties Stipulation, the Demurrer of Defendants Brian Raposo, Kovarus, Inc., and Ahead, Inc. is ordered OFF CALENDAR and further proceedings on the demurrer are STAYED.

2.  An Order to Show Cause re Dismissal based on the Settlement is set for hearing on December 1, 2023 at 8:30 a.m. in Dept. 68.

3.  In the event that a dismissal of this entire action is filed at least 4 court days prior to the hearing of December 1, 2023, the hearing shall be taken off calendar.
