Motion to Advance Post-Arbitration Status Conference and Hold Case Management Conference

Motion

            Plaintiff APB Properties, LLC (Plaintiff) has filed a motion requesting that the Court advance the post-arbitration status conference and hold a case management conference due to Defendant Jeff Kern’s (Defendant) failure to pay arbitration fees. JAMS has indicated that the arbitration was to be closed due to Defendant’s failure to pay arbitration fees as of November 16, 2023. Plaintiff has provided documentation of Defendant’s failure to pay. Defendant has not filed any opposition. Plaintiff filed a notice of non-opposition that indicates that JAMS has in fact closed the arbitration file.

The current post-arbitration conference is set for December 2, 2024. Plaintiff has requested that the Court advance the conference to the hearing date for this motion and hold a case management conference.

Order

The Court grants Plaintiff’s motion. The post-arbitration conference currently set for December 2, 2024, is advanced to December 27, 2023. A case management conference will also be held on the date of the hearing.
