Plaintiff James R. Laughlin's Motion to Compel Further Responses to Requests for Production, Set One is GRANTED in full. Sanctions are granted in the reduced amount of $500.00.
The scope of discovery is broader than those documents that pertain solely to Plaintiff's vehicle, but not unlimited. The RFPs are granted to the degree they concern either the subject vehicle or vehicles purchased in California of the same year, make, and model as the subject vehicle. In other words, when responding to requests related to 'CADILLAC VEHICLES,' Defendant may limit its responses only to 2016 Cadillac CT6 and not Cadillac vehicles more generally.
Additionally, documents reflecting policies and procedures used to evaluate Plaintiff's claims and similar claims are within the scope of discovery. Defendant is also required to search and produce responsive emails. At this time, no declaration is required from Defendant's custodian or employee regarding the searches performed. However, in the event Defendant does not appear to be fully forthcoming with their discovery productions, the parties are ordered to return to this court ex parte for further direction.
Defendant is ordered to produce documents within 30 days. If Defendant withholds documents based on privilege, a privilege log must be produced. The parties are directed to stipulate to a protective order as the parties have indicated is necessary.
