Plaintiffs Sergio Padilla and Sergio Padilla, Jr.'s Motion to Compel Further Responses to Requests for Production is GRANTED in part and DENIED in part.
The motion is granted as to all RFPs other than RFP No. 32, with the following clarifications.
The RFPs are granted to the degree they concern either the subject vehicle or vehicles purchased in California of the same year, make, and model as the subject vehicle. In other words, the scope of discovery is broader than those documents that pertain solely to Plaintiffs' vehicle. Moreover, Defendant is ordered to produce any internal documents referring to Plaintiffs' or the subject vehicle as requested in RFP No. 12 (i.e., documents reflecting communications or reports shared between Defendant's employees). It is insufficient to produce documents reflecting communications with Plaintiffs.
Additionally, documents reflecting policies and procedures used to evaluate Plaintiffs' claims are within the scope of discovery. These requests are therefore granted except that RFP Nos. 17-31 are limited to the period of 2019 to present.
RFP No. 32 is overbroad and the motion is denied as to that request.
Defendant is ordered to produce documents within 30 days. If Defendant withholds documents on the basis of privilege, a privilege log must be produced. The parties are directed to stipulate to a protective order if necessary.
