Plaintiff Maria Velazquez Barajas and Oscar Rodriguez's unopposed Motion to Compel Further Responses to Requests for Production of Documents, Set Two is GRANTED as described below.
Sanctions are granted in the reduced amount of $500.
The scope of discovery is broader than those documents that pertain solely to Plaintiff's vehicle, but not unlimited. The RFPs are granted to the degree they concern either the subject vehicle or vehicles purchased in California of the same year, make, and model as the subject vehicle. In other words, when responding to requests related to 'CHEVROLET VEHICLES,' Defendant may limit its responses only to 2021 Chevrolet Silverados and not Chevrolet vehicles more generally.
Additionally, documents reflecting policies and procedures used to evaluate Plaintiff's claims and similar claims are within the scope of discovery.
Defendant is ordered to produce documents within 20 days. If Defendant withholds documents on the basis of privilege, a privilege log must be produced. The parties are directed to stipulate to a protective order as Defendant has indicated is necessary. As for sanctions, this court has presided over nearly identical motions between the same firms in recent months and finds imposing no more than $500 to be reasonable.
