CASE TITLE: CASE TYPE:

Civil - Unlimited  Breach of Contract/Warranty Discovery Hearing 37-2022-00022703-CU-BC-CTL FUENTES VS GENERAL MOTORS LLC [IMAGED] CAUSAL DOCUMENT/DATE FILED: Motion to Compel Discovery, 06/06/2023

Plaintiff Mayra Negrete Fuentes' Motion to Compel Further Responses to Requests for Production is GRANTED in part and DENIED in part. The motion is granted as to all RFPs other than RFP Nos. 2, 7, and 105, with the following clarifications.

The scope of discovery is broader than those documents that pertain solely to Plaintiff's vehicle, but not unlimited. The RFPs are granted to the degree they concern either the subject vehicle or vehicles purchased in California of the same year, make, and model as the subject vehicle. In other words, when responding to requests related to 'CHEVROLET VEHICLES,' Defendant may limit its responses only to 2013 Chevrolet Cruzes and not Chevrolet vehicles more generally that may share some components with the subject vehicle.

Additionally, documents reflecting policies and procedures used to evaluate Plaintiff's claims are within the scope of discovery. These requests are therefore granted except that RFP Nos. 93, 95, and 105 are limited to the period of 2015 through 2019.

Defendant is ordered to produce documents within 30 days. If Defendant withholds documents on the basis of privilege, a privilege log must be produced. The parties are directed to stipulate to a protective order as Defendant has indicated is necessary.
