BACKGROUND 

Plaintiff Mid-Century Insurance Company filed this action against Defendant Big Q Auto Repair LLC dba Big Q Auto Repair for unpaid premiums on a workers compensation insurance policy.  

 On May 16, 2023, Plaintiff filed a Notice of Settlement of Entire Case with this Court.  The notice of settlement stated settlement was conditioned on the satisfactory completion of certain specified matters within 45 days of the date of the settlement.   

This hearing is on Plaintiff’s motion to vacate notice of settlement.  Plaintiff requests that the notice be vacated because Defendant purportedly has not complied with its obligations under the settlement agreement.  There was no opposition filed as of the posting of this tentative ruling. 

DISCUSSION 

Plaintiff’s motion to vacate notice of settlement is granted.  The notice of settlement was conditioned on Defendant’s completing specified items within 45 days of the date of settlement.  Defendant failed to comply with the terms of the settlement agreement.  According, grounds exist to vacate the notice of settlement.   

CONCLUSION 

For the foregoing reasons, the Court GRANTS the motion to vacate notice of settlement. This action is reinstated.  The Court sets a case management conference for January 20, 2025 at 8:30 a.m.
