This action arises from a dispute over an investigation conducted by Defendant the California Civil Rights Department (“CRD”) into a complaint for alleged violations of the Unruh Act made by Plaintiff Justin Jermaine Wills against his commercial landlord, Westwood Venture LLC (“Westwood”).  Dissatisfied with the outcome of the investigation, Plaintiff sued CRD and two of its employees.   

On January 17, 2023, Defendants filed their demurrer to Plaintiff’s first amended complaint.  On February 17, 2023, this Court heard oral arguments on the demurrer, which was sustained without leave to amend.   

Code Civ. Proc. §581(f)(1) provides that “after a demurrer to the complaint is sustained without leave to amend and either party moves for dismissal,” the court may “dismiss the complaint as to that defendant.”  Because Defendants’ demurrer was sustained without leave to amend, the Court grants Defendants’ motion to enter an order of dismissal and enter judgment in Defendants’ favor.
