Defendant-in-intervention Winhall 5, LLC (“Moving Defendant”) filed a virtually identical demurrer against Intervenor Michael L. Magasinn as Trustee of the Shamsam Irrevocable Trust in Case No. 23SMCV03694.  The Court sustains the demurrer in this case with 20 days’ leave to amend for the same reasons articulated in its November 3, 2023 order in Case No. 23SMCV03694.
