TENTATIVE RULING

The Parties’ Motion for Final Approval of Class Action Settlement is CONDITIONALLY GRANTED as the settlement is fair, adequate, and reasonable.  Specifically, the Parties’ Motion for Final Approval of Class Action Settlement is GRANTED CONTINGENT on Counsel submitting declaration(s) that adequately address the following:

Class Counsel are requesting costs in the amount of $43,436.64. Costs include Expert Data Consultant Fees of $8,475. (Bibiyan Decl. ISO Final ¶17 and Exhibit 3; Martinez Decl. ISO Final ¶15 and Exhibit 3; Szamet Decl. ISO Final ¶14 and Exhibit 6.)  Please identify the Expert Data Consultant whom Class Counsel retained, describe the services provided by this Expert Data Consultant, and if possible attach an invoice for this Expert Data Consultant.

If the Parties file and serve supplemental papers by 12 noon on April 18, 2025, then the Court will review the supplemental papers and issue a ruling on the currently set hearing date of April 22, 2025.  If the Parties are unable to file supplemental papers by 12 noon on April 18, 2025, then the hearing may have to be continued to the next available hearing date.
