tentative and elect not to appear at the hearing, the opposing party may
nevertheless appear at the hearing and argue the motion, and the Court may
decide not to adopt the tentative ruling.

advance, and no parties appear at the motion hearing, the Court may elect to
either adopt the tentative ruling or take the motion off calendar, in its
discretion.

On July 14, 2023, Plaintiff filed a motion for summary
adjudication of the pre-condemnation claim for damages in Defendants Dev Anand
Bhalla and Roopa Bhalla’s First Amended Answer to the Complaint in Eminent
Domain. On September 29, 2023, pursuant
to the parties’ stipulation, Defendants
Dev Anand Bhalla and Roopa Bhalla dismissed their claim for pre-condemnation
damages as asserted in their First Amended Answer to the Complaint in Eminent
Domain. Accordingly, Plaintiff’s motion
for summary adjudication scheduled for October 6, 2023 is taken off calendar as
MOOT.
Plaintiff is to give notice of this order and file proof of
service of such within 10 days.
