1. If you wish to submit on the tentative ruling,

the day of the hearing, and please notify all other parties in advance that you
will not be appearing at the hearing. Include the word "SUBMISSION" in all caps in the
subject line and include your name, contact information, the case number, and
the party you represent in the body of the email. If you submit on the
tentative and elect not to appear at the hearing, the opposing party may
nevertheless appear at the hearing and argue the motion, and the Court may
decide not to adopt the tentative ruling.

For any motion where no parties submit to the tentative ruling in
advance, and no parties appear at the motion hearing, the Court may elect to
either adopt the tentative ruling or take the motion off calendar, in its
discretion.

Defendant's ex parte application to enlarge trial estimate and to continue the trial is continued to November 20, 2023 at 8:30 am -- the same date that Defendant's motion to consolidate cases shall be heard.
Unless and until the Court grants Defendant's motion to consolidate cases, Defendant's ex parte application to enlarge the trial estimate arising out of consolidation is premature.
With regard to Defendant's ex parte application to continue the trial, the Court reminds the parties that the Court has already previously granted a continuance of the trial to the current trial date. In doing so, it was made clear to the parties that "[t]he new trial date of 1/22/24 that the Court has set is a firm trial date." (9/15/23 Minute Order.) Accordingly, the parties must pursue discovery and trial preparation with diligence. Unless and until the Court grants Defendant's ex parte application to continue the trial, the parties must pursue all discovery, motions, and trial preparation with diligence.
