Plaintiff’s Ex Parte Application TO ADVANCE HEARING DATE ON HIS MOTION TO COMPEL DESIGNATION AND DEPOSITION OF DEFENDANTS PERSON(S) MOST QUALIFIED AND REQUEST FOR PRODUCTION OF DOCUMENTS AT DEPOSITION, AND REQUEST FOR MONETARY, ISSUE, AND EVIDENTIARY SANCTIONS is CONTINUED to August 16,2023 at 8:30 am.

 

The parties are ordered to meet and confer no later than 10 am on August 14, 2023 by real time conversation (face-to-face or by telephone – not a mere exchange of correspondence) in good faith to attempt to agree on a date for Plaintiff to depose Defendant’s PMK.  If the parties have disputes concerning the categories for the deposition notice, the Court suggests that the parties refer to the Court’s lemon law discovery addendum during their meet and confer.

 

If the parties are able to resolve all their discovery disputes, including the setting of a date for the deposition of Defendant’s PMK, the moving party must promptly cancel all the online Court Reservation System (CRS) reservations for discovery motions hearing that will no longer be necessary in light of the parties’ stipulations, and the moving party must also file and serve a notice of taking the instant ex parte application off calendar.

 

If the parties are unable to resolve all their discovery disputes, then no later than August 15, 2023, the parties must file one joint statement not to exceed 3 pages (1 ½ pages for each side) summarizing discovery issues that remain in dispute, including any dates that Defendant has offered for its PMK’s deposition to proceed.
