The criminal history assessment that the Probation Office has run through CLETS reveals that Petitioner has an active outstanding warrant: The Probation Officer has noted that Petitioner has an outstanding Bench Warrant with bail of $5,000 issued in Case# LAM9MP01857-01.

On September 25, 2023, the Court continued the instant petition for Petitioner to clear the outstanding bench warrant and file evidence of such.  However, Petitioner has failed to do so.  Accordingly, the petition is DENIED WITHOUT PREJUDICE.

The petition is denied on the additional ground that no proof of publication has been filed.  The Court has already continued the hearing once to allow Petitioner additional time to file proof of publication, but Petitioner has nonetheless failed to file proof of publication.  The petition is dismissed without prejudice.  Petitioner may file a new petition and file proof of publication.
