The criminal history assessment that the Probation Office has run through CLETS reveals that Petitioner has an active outstanding warrant. The Probation Officer has noted that Petitioner has an outstanding bench warrant in Texas, Bail: Unknown, Case # 159346 (Texas) issued 11/16/18.

On September 25, 2023, the Court continued the instant petition for Petitioner to clear the outstanding bench warrant and file evidence of such.  However, Petitioner has failed to do so.  Accordingly, the petition is DENIED WITHOUT PREJUDICE.

The Court Clerk is to give notice to all parties.
