The Court is inclined to grant FEDEX GROUND PACKAGE SYSTEM INC.'s ex parte application for an order granting the APPLICATION AND DECLARATION FOR ADMISSION PRO HAC VICE OF BRETT M. WENDT TO THE BAR OF THIS COURT ON BEHALF OF DEFENDANT FEDEX GROUND PACKAGE SYSTEM, INC. However, FEDEX has failed to provide evidence of compliance with CRC 9.40(c)(1), which provides that “a person desiring to appear as counsel pro hac vice in a superior court must file with the court a verified application together with proof of service . . . of a copy of the application and of the notice on all parties who have appeared in the cause and on the State Bar of California at its San Francisco office.”  Prior to the continued hearing on the instant ex parte application, FEDEX must file and serve proof of payment to the California State Bar and proof of service of the application on the California State Bar.
