CASE MANAGEMENT
ORDER
The Court has read the Joint
Status Conference Report filed in this case and issues the following Case
Management Order:
1.
Defendants report that the insurance carrier has
accepted the claim.
2.
The Court lifts the stay and orders Defendants
Rosecrans Place, LLC and G3 Urban are to file responsive pleadings by no later
than May 30, 2025. If either Defendant wishes to challenge the
complaint, Defendant must call the Court PRIOR to filing and serving such
demurrer or motion to strike to obtain a hearing date and briefing schedule. The Court hereby sets a Non-Appearance
Case Review re responsive pleading for June 6, 2025, at 8:30 a.m., Department 9.
3.
Defendants report that the insurance carrier has
accepted the claim.
4.
The parties will meet and confer to discuss the
potential for setting up a mediation.
The parties are to file a joint status report that includes a discussion
of their mediation efforts no later than October 16, 2025. The Court hereby sets a Non-Appearance Case
Review re mediation for October 23, 2025, at 8:30 a.m., Department 9.
5.
The parties all state today in court that none
of them are aware of any case related with the instant case.
6.
Potential Related Cases. Counsel are ordered to file and serve a
Notice of Related Case for any potentially related cases pursuant California
Rule of court Rule 3.300, including any PAGA case involving the same
representative plaintiff. This is a
continuing obligation on both plaintiffs and defendants while this case is
pending.
7.
Phased Discovery. The parties have agreed that by no later
than April 30, 2025 a revised Stipulation and Case Management Timeline with
dates set forth for phases of discovery; the parties will remove any dates to
which the parties do not reach a stipulation.
Discovery remains stayed until the Court signs the anticipated Stipulation
and Case Management Timeline. Any terms as
to which the Parties cannot reach agreement should be addressed in the Joint
Status Report to be filed one week prior to the next status conference.
8.
Protective Order. Parties are alerted that model protective
orders may be found at Los Angeles Superior Court website at
http://www.lacourt.org under “Tools for Litigators.” The parties are encouraged to use these model
orders as shown, or if modified, as a template for the modified order. A redlined courtesy copy is to be posted on
the e-service bulletin board and lodged with the court at the time of filing.
The parties are to use the redlined version to identify any changes proposed to
the model order.
9.
Telephonic conferences. The Court handles pleading and discovery
motions informally, using telephonic conferences and LA CourtConnect. Counsel
must post a message via their Electronic Service Provider to request any
informal discovery conference or other conference. The Court will either reply
to the message or issue a Minute Order setting the conference. The telephonic conference will automatically
be taken off calendar if all relevant parties have not scheduled the telephonic
conference with LA CourtConnect. Parties
must file and serve a 5-page joint brief two days before the conference. Since
these conferences are informal, no court reporter or audio recording is
permitted.
10.
Status conference. Status Conference is set for July 16, 2025, 10:00
a.m., Department 9. All counsel are
ordered to appear. The parties are
ordered to file a joint status report by no later than July 9, 2025,
including a proposed discovery plan and proposed case management dates.
