10/26/22 Minute Order

The parties participated in a conference regarding jury instructions with the Court today.

If they have not already done so, all parties are to electronically file and serve the language of all non-CACI instructions that they are proposing, including the authority supporting those non-CACI instructions.  The parties must do so no later than 8:00 pm on October 26, 2022.

No later than 9:00 am on October 27, 2022, all parties are to electronically file and serve the language of all additional CACI instructions that the party is proposing that do not appear in the CACI instructions that the Court has distributed twice, including on October 17, 2022.

With regard to any non-CACI jury instructions that the parties are each proposing, the parties are to prepare a joint chart/table that identifies for each such instruction: (1) the special instruction number and title (i.e. “Plaintiff’s special instruction #1”), (2) any CACI instruction that covers this subject or a related topic and that might render this special instruction duplicative or unnecessary, (3) any other reason(s) for the opposing party’s objection to this special instruction summarized in 2-3 sentences with citation to one best authority supporting the party’s position, (4) any reason(s) why the party proposing this special instruction believes that any related CACI instruction(s) do not adequately address this subject in 2-3 sentences with citation to one best authority supporting the party’s position. No later than 8 pm on October 26, 2022, each party proposing special jury instructions must email to all other parties the first and fourth columns of the joint chart. All other parties are to complete the second and third columns of the joint chart and email the updated joint trial documents to other party no later than  11:59 pm on October 26, 2022 with their electronic signatures.  No later than 9 am on October 27, 2022, each party is to file and serve the joint chart for its proposed special instructions.

No later than 9:30 am on October 27, 2022, all parties to appear in Department 26 and deliver to Department 26 conformed courtesy copies of all their filings regarding jury instructions, including each party’s (1) objections to the CACI instructions that the Court has distributed twice, including on October 17, 2022; (2) all additional CACI instructions that the party is proposing that do not appear in the CACI instructions that the Court has distributed twice, including on October 17, 2022; (3) all non-CACI instructions that the parties are proposing; and (4) the joint chart on each party’s non-CACI instructions (including the opposing party’s objections to those non-CACI instructions).  The copies that the parties deliver to Department 26 on October 27, 2022 must be conformed and must show the electronic filing banner at the top of the filing.

The Court Clerk is to give notice to all parties electronically.
