On June 15, 2022, Plaintiff filed two Motions For Settlement
Under The California Labor Code Private Attorneys General Act (Penalties
Pursuant To Labor Code §558). The Court
requests clarification whether the two motions are identical copies of each
other.
Assuming that the two motions are identical and were merely
inadvertently filed twice, the Court is prepared to approve the parties’ settlement
under the California Labor Code Private Attorneys General Act (Penalties
Pursuant to Labor Code §558). However,
the Court points out that although the settlement includes a request to retain
jurisdiction to enforce the settlement under CCP section 664.6, the proposed
order electronically lodged on June 15, 2022 does not include any provision for
the Court to retain jurisdiction under CCP section 664.6 to enforce the
settlement.
If the parties wish for the Court to retain jurisdiction
under CCP section 664.6 to enforce the settlement, they should either electronically
file a new proposed order adding this provision, or they can request the Court
to amend the June 15, 2022 order to add a provision retaining jurisdiction
under CCP 664.6.
