Plaintiff’s
Motion to Compel Compliance with Discovery Order
On
November 4, 2022 the court granted plaintiff Raymond Estevez’s motion to compel
further responses to a request for production of documents in this lemon law
case. Defendant GM was ordered to produce further responses to RFPs related to
defendants’ internal investigations, policies and procedures. On January 20,
2023, GM produced further documents. Estevez argues the production is
insufficient and moves to compel further production. 
Estevez
argues GM failed to produce vehicle warranty history reports in response to
request no. 41, internal emails reflecting defendants’ knowledge of defects in
the subject vehicle in response to request no. 51, organizational charts and
documents reflecting warranty and vehicle repurchase policies in response to
requests nos. 7, 34, 38, and 42. Estevez seeks an order that these specific
documents are produced, and issue sanctions for failure to comply with the prior
order. 
GM
produced supplemental responses to all requests identified in the order. It
identified the Bates stamp number of each responsive document, allowing Estevez
to match each produced document to a specific request. Estevez has not provided
sufficient evidence to conclude that further responsive documents exist and
were not produced. DENIED.
