Cross-Defendant Elysienne, LLC Motion to Compel Responses to Form/Special Interrogatories and Requests for Production and to Deem RFA’s Admitted (UNOPPOSED)

On March 22, 2023 cross-defendant Elysienne served written discovery on Pineapple Ventures and Zadeh. Cross-defendants did not respond, nor respond to a July 11, 2023 meet and confer letter, nor appear at a July 27, 2023 informal discovery conference. At a case management conference on November 1, 2023, Pineapple and Zadeh represented they would respond within one week. They have not done so.

Responses to written discovery requests are due within 30 days of service. Cal. Code of Civ. Proc. §§2033.250(a), 2030.260(a), 2031.030(c). When timely responses to requests for admission are not served, the requesting party may move for an order that the genuineness of any documents and the truth of any matters specified in the requests be deemed admitted. Cal. Code of Civ. Proc. §2033.280(b).

Zadeh and Pineapple have not responded. Morrow decl. ¶¶3-8. There is no opposition. Vincent and Pineapple failed to respond. GRANTED. Vincent and Pineapple to provide verified responses without objection within 20 days. RFAs deemed admitted.
