Plaintiff VST 2020-NPL1 REO’s Motion for Terminating/Monetary Sanctions against Defendant Adjed (UNOPPOSED)

 

On March 27, 2023 the court granted plaintiff VST 2020’s motion to compel responses to written discovery against defendant Adjed. VST states Adjed failed to timely comply with the order and did not respond to a letter stating VST intended to seek terminating sanctions.

 

Terminating sanctions are justified when a party has been ordered to produce responses to interrogatories and/or requests for production of documents but fails to do so. Cal. Code of Civ. Proc. §2031.300(c); 2030.290(c).

 

Defendant Adjed did not produce responses to VST’s initial discovery responses, did not attend the hearing on VST’s motion to compel responses, did not comply with the court’s order to respond to discovery and does not oppose this motion. This strongly suggests Adjed abandoned the litigation, and Adjed has given the court no reason to believe he will comply with his discovery obligations. Terminating sanctions are warranted, as are the monetary sanctions of $2,200 VST requests. GRANTED. Sanctions payable within 30 days.
