Delshad and Simon’s Caterers seek leave to amend the answer, naming the correct
defendants, removing third party Simon E. Cohen and noting that Simon’s
Caterers, Inc. was erroneously sued and served as “Simon’s Caterers, inc. dba Simon’s
Caterers.”
Absent prejudice to the opposing party, courts
exercise liberality in allowing amendments to pleadings at any stage of
litigation. E.g. Slack v. Metropolitan
Trust Co. (1935) 9 Cal.App.2d 86.
Considering the liberal
policy in favor of allowing amendments, and that plaintiff has not opposed, the
motion is GRANTED.
