Ex Parte Application for TRO/Preliminary Injunction

Plaintiff Blue Shield moves for injunctive relief to prevent defendant Advanced Orthopedic Center from filing duplicative lawsuits arising out of the same patient reimbursement claims. While such an injunction is expressly permitted under Cal. Code of Civ. Proc. §526(a)(6), Blue Shield failed to show the possibility of additional actions being filed against it constitutes an emergency or irreparable harm justifying ex parte relief. Further, the request is speculative, as no other matters have been filed. The injunction request must be made via noticed motion and heard on the court’s regular calendar. DENIED.
