Petition to Approve Minor’s Compromise
Plaintiff
Chekosari as an individual and as guardian ad litem for Kimiya Taghdiriazar, a
minor, sues defendants Hannon and Blake for injuries arising from an automobile
collision. Plaintiff petitions for approval of minor’s compromise. The balance
of proceeds is to be placed in a blocked account until the minor reaches 18
years of age. Minors Comp. para. 18(b)(2).
Defendants
offer $100,000. Minors Comp. para. 10(b). Minor Kimiya suffered lumbar,
cervical and hip injuries and underwent chiropractic and physical therapy.
Minors Comp. paras. 6-7. Minor Kimiya has recovered from all injuries. Minors
Comp. para. 8(a).
Kimiya
incurred $38,402 in medical expenses, with $14,925 to be reimbursed. Minors
Comp. para. 12(a). Attorney’s fees totaling $33,300 are requested. Minors Comp.
para. 13(a). Costs of $262.50 are requested. Minors Comp. para. 13(b). The balance
of proceeds after requested reimbursements, fees and expenses total $51,482.50
to be placed into the blocked account. Minors Comp. para. 16.
The
settlement is reasonable, and the procedural requirements are met. GRANTED.
