Plaintiffs’
Motion to Compel Discovery and for Monetary Sanctions
Plaintiffs
Yashouafar sue defendants Stephanie Frederic and FGW Productions, Inc. for
unlawful detainer. Plaintiffs served defendants with requests for production
and admissions 7/17/24. Defendants failed to respond. Plaintiffs move to compel
discovery and for monetary sanctions totaling $960. No opposition was filed.
When
a party fails to timely respond to written discovery requests, including
interrogatories and requests for production of documents, propounding party can
move for an order compelling a response without objections. Code of Civ. Proc.
§2023.290. If a party fails to serve timely responses to requests for
admission, the requesting party can move for an order deeming the truth of any
matter specified in the requests admitted. Code of Civ. Proc. §2033.280.
Plaintiffs
served general form interrogatories, unlawful detainer form interrogatories, requests
for production of documents and request for admissions on 7/17/24. Decl. Zakari
paras. 3-7. Defendants failed to respond. Decl. Zakari para. 8. Plaintiffs
attempted to meet and confer with defendants, to no avail. Decl. Zakari para. 8.
At an informal discovery conference 10/17/24 the court ordered defendants to
produce discovery. Min. Order 10/17/24. Defendants failed to comply with the
court’s order and have not responded to any of plaintiffs’ communications.

Defendants
do not oppose the instant motion. Plaintiffs’ motions and request for sanctions
are meritorious. Plaintiffs’ counsel spent 2 hours preparing the instant motion
at $450/hour. Decl. Zakari para. 9. Plaintiffs request $60 in filing fees. Id.
Plaintiffs seek $960 in total.
GRANTED.
Sanctions payable within 30 days.
