Martin’s Motion to Vacate Wrongful Judgment
Plaintiff
King, Holmes, Paterno & Berliner LLP sued defendant Martin in 2004 to
collect unpaid legal fees. Judgment was entered 11/29/04, renewed 11/25/14, and
renewed again 11/19/24. Defendant, in pro per, moves to vacate the judgment,
asserting “I was not present to defend myself, nor was I aware of this recent
renewal of judgment over 21 years later.” Mtn. 1:26-27. No proof of service was
filed, and there is no indicia plaintiff received notice.
Defendant’s
motion cites no case law. Defendant asserts he was never served the underlying
judgment, and the underlying judgment is baseless and over-inflated. Defendant
also pleads hardship. The motion is signed, but there is no declaration under
penalty of perjury or other evidence to support the claims. DENIED.
