Motion for Order to Issue Consumer Credit Report (UNOPPOSED)
Judgment was entered against defendant Frisco in favor of plaintiff Hamilton for $194,906.39. Hamilton states his attempts to recover the judgment – including collection calls, letters, a bank levy, and an Order for Appearance and Examination – were unsuccessful. Hamilton moves for issuance of a consumer credit report under Cal. Civ. Code §1785.11.
A consumer credit reporting agency shall only furnish a consumer credit report under specifically defined circumstances, including in response to the order of a court having jurisdiction to issue an order. Cal. Civ. Code §1785.3(c).
Hamilton argues the court should order an issuance of a consumer credit report to assist with enforcement of the judgment. Hamilton has not provided any statute or precedent indicating this is a proper basis for a court order under §1785.3. Though no opposition was filed, Hamilton must provide legal support for his request. DENIED without prejudice or continued, at plaintiff’s request.
