Defendants General Truck Drivers Office Food & Warehouse Local 952 and Eric Jimenez’ motion to seal records is DENIED. First, proof of service of the moving papers is defective, as the sender’s electronic email address is missing. (Code Civ. Proc., § 1013b, subd. (b)(1).) There is no responsive pleading by plaintiff waiving the defective proof of service. (See Carlton v. Quint (2000) 77 Cal.App.4th 690, 698 [response on merits can waive service defect].) Second, moving party failed to provide the required declaration “containing facts sufficient to justify the sealing.” (See Cal. Rules of Court, Rule 2.551, subd. (d)(1).)
