Judge: Erick L. Larsh, Case: 2020-01148592, Date: 2023-08-17 Tentative Ruling

The Hearing on Defendant Arnel Management Company’s Motion to Compel Plaintiff in Intervention Mark Rychlik to Serve Verified Responses Without Objections and All Responsive Records to Form & Special Interrogatories and Inspection Demands, Set No. 1 and Imposition of Monetary Sanctions is continued to September 29, 2023, at 1:30 p.m.

The proof of service for the moving papers is defective. Calif. Code of Civil Procedure, section 1013b requires that a proof of electronic service state the electronic service address of the person who served the pleading. (See Code Civ. Proc. § 1013b, subd. (b)(1).) In the absence of a responsive pleading, the court cannot determine whether the notice of motion was served in compliance with Calif. Code of Civil Procedure, section 1005, subdivision (b).

Defendant to file a competent, Code compliant proof of service for the moving papers within five days.

Defendant is ordered to give notice.
