Robert E. Gibson, Esq. and Law Office of Robert E. Gibson (“Counsel”) seeks to be relived as attorneys of record for Plaintiff Osterreich, LLC (“Plaintiff”).

Counsel seeks to be relieved on the grounds a conflict has arisen between Counsel and Defendant such that it makes it impossible to continue the representation. Counsel states he cannot reveal the nature of the conflict without divulging client confidences or breaching ethical duties and if the Court desires, the information can be red with the Court in camera outside of the presence of all other parties. (See Decl., ¶ 2.)

The Motion is unopposed, was properly served, and the moving attorney has stated a basis for permissive withdrawal under Rules of Professional Conduct, Rule 3-700. Further, the

Motion satisfies the requirements of Cal. Rules Court, Rule 3.1362. Therefore, the Motion is GRANTED.

The order becomes effective upon proof of service of the same on the client.

The Court sets an OSC re why Plaintiff’s Complaint should not be stricken for failing to retain new counsel for August 25, 2023, 9:00 a.m., Dept. C20.
