Defendant Hyundai Motor America’s motion to compel Plaintiff Eric I Orozco Frias to produce the subject vehicle for inspection is GRANTED. (Code Civ. Proc., § 2031.310 [authorizing motion]; Bassi Decl., ¶¶ 3-6 and Exs. A-D thereto.)
Plaintiff shall produce for inspection plaintiff’s 2018 Hyundai Santa Fe Sport, 5XYZT3LB8JG554718 and any parts, equipment, and/or accessories purchased for, installed on, connected with, or deriving from said vehicle, at Imperial Valley Hyundai, 634 Thomas Lane., El Centro, CA 92243 telephone (760) 273-0515, on September 8, 2024, at 10:00 AM. The inspection shall take place on to the terms set forth in moving party’s Amended Demand for Inspection of Property, served on April 20, 2023. (Ex. A to moving papers.)
The parties may agree in writing to conduct the inspection at a different date, time, and/or location.
Moving party’s sanctions request is DENIED, as the notice of motion does not comply with Code Civ. Proc., § 2023.040 [“A request for a sanction shall, in the notice of motion, identify every person, party, and attorney against whom the sanction is sought, and specify the type of sanction sought”].)
Moving party shall give notice.
