Defendant Zahra Abolghasemi’s demurrer to the Complaint is CONTINUED to September 29, 2023, at 1:30 p.m.

First, moving party failed to file the declaration required by Code Civ. Proc., § 430.41. The Court orders the parties to engage in Code-compliant meet and confer efforts, and orders counsel for moving parties to file a supplemental declaration demonstrating such compliance at least five court days prior to the continued hearing.

Second, proof of service of plaintiff’s Opposition is defective, as the sender’s electronic service address is missing. (Code Civ. Proc., § 1013b, subd. (b)(1).) There is no response by defendant waiving this defect. (See Carlton v. Quint (2000) 77 Cal.App.4th 690, 698 [response on merits can waive service defect].) Plaintiff is ordered to re-serve the Opposition by September 15, 2023, and file a Code-complaint proof of service of same by September 20, 2023.

Moving defendant shall give notice.
