The Hearing of Defendant Arnel Management Company’s Motion to Enforce Court Order is continued to September 14, 2023, @ 1:30 p.m.
The proof of service for the moving papers is defective. Calif. Code of Civil Procedure, section 1013b requires that a proof of electronic service state the electronic service address of the person who served the pleading. (See Code Civ. Proc., § 1013b, subd. (b)(1).) In the absence of a responsive pleading, the court cannot determine whether the notice of motion was served in compliance with Calif. Code of Civil Procedure, section 1005, subdivision (b).
Defendant to file a competent, Code-compliant proof of service for the moving papers within five days.
The court construes requests for relief (1) & (2) from the notice of this motion as a motion to compel further responses to plaintiffs’ responses served while and after the previous motions to compel were heard. Defendant to file and serve a separate statement for the disputed discovery responses within ten days.
Defendant is ordered to give notice.
