On
January 20, 2023, Mikayel Israyelyan (“Israyelyan”) filed his Motion to Compel Further
Responses to Requests for Production of Documents. Israyelyan requested that the Court issue an order compelling Kirkor Bardakjian
(“Bardakjian”) to respond to Israyelyan’s first set of
Requests for Production of Documents and to award monetary sanctions in the
amount of $3,661.65.
On February 17,
2023, Bardakjian filed his opposition. Bardakjian argued his subsequent production
of documents rendered the motion moot.
On March 3,
2023, the motion came on for hearing. The Court determined it could not rule on
the motion given Bardakjian’s subsequent production of documents and lack of
clarity as to which documents were still outstanding. The Court continued the
motion to April 14, 2023, pending further meet and confer or an informal
discovery conference. The Court also ordered Israyelyan to prepare a summary of documents which remained outstanding.
On April
11 at 10:46 p.m., Israyelyan filed a Separate Statement of documents which
remained outstanding. The Separate Statement is 298 pages in length and still requests
further production in relation to all 203 categories of documents. Israyelyan also submits a brief in
which he details some but not all the documents still outstanding. Israyelyan specifically identifies documents he
believed are missing in some circumstances such as statements from Chase Bank
and escrow documents for 485 Cliff Dr., LLC. (RFPD Nos. 6, 20-30.) However, Israyelyan
also groups together large numbers of RFPDs in which he claims Bardakjian has
produced some, but not all, documents. (RFDP Nos. 96-172.) It is unclear to the
court what remains to be produced as Israyelyan does not specify documents to
these requests as they do with previous RFPDs.
Given the
submission of the Separate Statement occurred only two days before hearing, and
the insufficiency of Israyelyan’s supplemental filings, the Court will again
continue the matter.
THE MOTION TO COMPEL FURTHER RESPONSES TO
REQUESTS FOR PRODUCTION OF DOCUMENTS IS CONTINUED TO APRIL 28, 2023 PENDING
FURTHER MEET AND CONFER OR AN INFORMAL DISCOVERY CONFERENCE.
ISRAYELYAN IS ORDERED TO PRODUCE A SUMMARY
OF ALL DOCUMENTS WHOSE PRODUCTION REMAINS.
SANCTIONS WILL BE DETERMINED AT THE NEXT COURT
DATE.
