On December 13, 2022,
Magdalena Privnic, in pro per, (“Plaintiff”) filed suit against Last Property
Management LLC, Babak Shokrian, and Juan Rubio (“Rubio”) (collectively
“Defendants”). The Complaint asserts causes of action for (1) Gross Negligence,
(2) Private Nuisance, (3) Breach of Covenant Quiet Enjoyment, (4) Failure to
Provide Habitable Dwelling, and (5) Fraud.
On January 17, 2023
Rubio filed this Demurrer and Motion to Strike as to Plaintiff’s complaint;
thereafter, on January 25, 2023, Plaintiff filed her First Amended Complaint
(“FAC”).
With the filing of
the FAC, Rubio’s Demurrer and Motion to Strike is now moot and off-calendar.

In the

order or the court in its discretion elects to sign a formal order, the
following form will be either electronically signed or signed in hard copy and
entered into the court’s records.
ORDER
Juan Rubio’s Demurrer
and Motion to Strike came on regularly for hearing on
March 17, 2023, with appearances/submissions as noted in the minute order for
said hearing, and the court, being fully advised in the premises, did then and
there rule as follows:
THE DEMURRER AND MOTION TO STRIKE ARE MOOT. THE
MOTION IS REMOVED FROM THE CALENDAR
DEFENDANT JUAN RUBIO TO GIVE NOTICE UNLESS ALL
PARTIES WAIVE NOTICE.
