EX PARTE APPLICATION FOR LEAVE TO SERVE DEPOSITION SUBPOENA

Los Angeles Superior Court Case # 23BBCV00051

 

 

Plaintiffs, Alan Spiegel and Steven Spiegel filed an ex parte application to serve a third-party deposition subpoena in this matter prior to service of the summons and complaint.  The complaint lists only Doe defendants as the true identity of the defendant using the Instagram Account name of “Card Porn” (referring to sports trading cards) is unidentified. 

 

Plaintiff asserts that the unnamed defendant is represented by Ken White, Esq. of Brown, White and Osborne LLP (Decl. Vasina ¶2). 

 

The Court finds that the Plaintiffs have meet the notice requirement pursuant to CRC 3.1204, and has presented sufficient cause to grant the ex parte application.

 

RULING:

 

In the event the parties submit on this tentative ruling, or a party requests a signed order or the court in its discretion elects to sign a formal order, the following form will be either electronically signed or signed in hard copy and entered into the court’s records. 

 

 

ORDER 

 

Plaintiff’s Ex-Parte Motion for Application for Leave to Serve Deposition Subpoena came on ex parte for hearing on February 7, 2023, with appearances/submissions as noted in the minute order for said hearing, and the court, being fully advised in the premises, did then and there rule as follows: 

 

THE MOTION FOR EX PARTE LEAVE TO SERVE A DEPOSITION SUBPOENA IS GRANTED.
