Michael Ray Jaimes v. Solomon J. Kim, et al., Case No. 23STCV01296

Plaintiff took a default of Defendant Woo H. Jim (“Defendant”) on August 8, 2023.  Now, Defendant moves ex parte to set aside the default.  The Court orders as follows:

1.       The Court advances and vacates the hearing on the Order to Show Cause re: Default Judgment, set for October 5, 2023, at 8:30 a.m.

2.       The Court shall treat Defendant’s ex parte application as a noticed motion, which shall be heard on October 5, 2023, at 8:30 a.m.

3.       Plaintiff may file an opposition, and Defendant may file a reply brief, based upon statutory deadlines.

4.       The Court shall hold a case management conference on October 5, 2023, at 8:30 a.m.

5.       The Court orders Plaintiff’s counsel not to submit a default judgment packet until the Court resolves the pending motion.

6.       Defendant’s counsel shall provide notice and file proof of such with the Court.
