RELIEF REQUESTED
John S. MacIntosh, counsel of record for Defendant PWP
Properties, Inc., seeks to be relieved as counsel for that party. Counsel filed a motion with the required
forms MC-051, MC-052, and MC-053.
Counsel’s declaration states PWP Properties is precluded by law from
representing itself in this case, and counsel was unable to obtain a
Substitution of Attorney from PWP Properties.
Counsel notes that PWP Properties’ principal, defendant Edward Poulin,
executed a Substitution of Attorney for himself as an individual. Additionally, counsel and PWP Properties have
reached an impasse as to how to most effectively approach these proceedings
which has made it unreasonably difficult for counsel to carry out his duties.
Absent a showing of resulting prejudice, an attorney’s
request for withdrawal should be granted.¿ (People v. Prince¿(1968) 268
Cal.App.2d 398, 406.)¿ There is no showing of prejudice, and counsel’s motion
complies with California Rules of Court, Rule 3.1362 and meets its
requirements.
