TENTATIVE RULING

            Devean Lee Carter’s Petition to Withdraw Funds from Blocked Account is granted.

            Background

Plaintiff filed the Complaint on January 10, 2011. The action stems from a dog bite. The minor Plaintiff, at the time, settled the action which resulted in net settlement proceeds of $20,000.00 which was placed in a blocked account.

Petition to Withdraw Funds from Blocked Account

A petition for the withdrawal of funds deposited for a minor or a person with a disability must be verified and include the identity of the depository, a showing of the amounts previously withdrawn, a statement of the balance on the deposit at the time the petition is filed, and a justification for the withdrawal. Cal Rules of Court, Rule 7.954(a); Cal Rules of Court, Rule 3.1384(b). Petitioner has adequately satisfied the requirements to withdraw funds deposited in the bank account. The former minor Plaintiff has now reached the age of majority.

Therefore, the Petition to Withdraw Funds from Blocked Account is granted.

Petitioner is ordered to give notice of this ruling.
